Please read these Terms of Service and our Privacy Policy carefully before using EvolutionRed Services.Whenever you use the Services, you agree to be bound by all of the terms and conditions of these Terms of Service. If you don’t agree to all the terms and conditions you must not use our Services.
We reserve the right, at our discretion, to change, modify, add or remove portions of the Terms of Service at any time.  If you continue to use the Services after the changes are posted you agree to the changes.
You are responsible for maintaining the security of your Account. Don’t share your Account details with others or allow others to access or use your Account. You are solely responsible for any activity in your Account whether or not authorized by you, including purchases made using any payment instrument (for example, credit card, PayPal or social network or platform virtual currency).

If you are between the ages of 13 and 17, or under the age of majority where you live, you represent that your legal guardian has reviewed and agreed to these Terms.

The Service is comprised of works owned by EvolutionRed, and it is protected by copyright, trademark, trade dress, patent and other US and non-US intellectual property and other applicable laws, rules or regulations. EvolutionRed owns, has licensed, or otherwise has rights to use all of the content that appears in the Service. These Terms do not grant you or any other party any right, title or interest in the Service or any content in the Service.

You understand that while you may “earn” "buy" or "purchase" Virtual Items in our Services, You do not legally "own" the Virtual Items and the amounts of any Virtual Item do not refer to any credit balance of real currency or its equivalent.  You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. EvolutionRed may revise the pricing for the goods and services it licenses to you through the Service at any time. 

All sales are final.  All sales are valid for the device on which they were originally purchased from and are non-transferable.  To ensure the best possible user experience, do not delete cookies stored on your device.  Information regarding your game progress and the items you have purchased may be interrupted if any corresponding cookies are deleted.  We are not responsible for progress or other game interruptions resulting from unavailable cookies.  It is your responsibility to ensure that this information remains available on your device.

Use of the service is at your sole risk. It is provided on an "as is" basis. To the extent permitted by applicable law, EvolutionRed and any EvolutionRed affiliate make no warranties, conditions or other terms of any kind, either express or implied, about the services.

Data Collection, Storage, Processing, and Deletion Requests:

Data deletion requests can be sent to user.data@evolutionred.com. Please include your full name and on which game you're requesting data deletion for. We collect and store user name and facebook game id in order to display user progress on leaderboards and communicate in multiplayer games if applicable. We collect and store in game activity such as level progress, coins purchased, and game login activity. These are collected in order to store game progress and allow users to login at a later time to continue their game. We may periodically collect data about activity within the game in order to analyze our games for errors and improve user enjoyment.

Personal Data: Your Rights and How to Access, Update, and Manage Your Personal Information If you’re a user located in the UK or European Countries, you have certain rights with respect to your personal information. UK and European Countries’ Users’ Rights- If you are located in the UK or European Countries, you have the following data protection rights:

To exercise your rights to access or deletion, please submit a request through email: user.data@evolutionred.com. Please include game ID, user name and game title. If you are located in the Republic of Turkey, you have the rights listed under Article 11 of the 6698 No. Law on Protection of Personal Data. Contact Us for your queries and requests. Accessing and Deleting Personal Information You can request a copy of or deletion of your game account data through email. If you want to review or delete personal information associated with your game account data, please submit a request through email: user.data@evolutionred.com. For deletion requests, we will take reasonable measures to delete your personal information from our records. If you have sent content through or posted content on the Service, we may not be able to delete it. We will keep certain records (e.g., personal information relating to payments or customer service matters) where we need (and have rights) to, such as for legal or accounting purposes. We’ll also keep information in order to exercise, defend, or establish our rights. Managing Personal Information We Receive From Third-Party Applications / Platforms And From Your Mobile Device To manage the information we receive from third-party applications or platforms and from your mobile device, use the tools and settings provided by the third-party application and your mobile device. To manage the information EvolutionRed receives about you from a third-party application or platform where you play our games, like Facebook, Apple, Google, or Amazon, you will need to follow the third-party application’s instructions for updating your information and changing your privacy settings. You also can manage many aspects of information collection and use from your mobile device by visiting the “settings” page of your mobile device or web browser and reviewing the access permissions of each EvolutionRed game / application. Once EvolutionRed receives your information from a third-party application / platform or your mobile device, that information is stored and used by EvolutionRed in accordance with this Privacy Policy. You may access and update that information as described above. Opting Out of Promotional Communications from EvolutionRed You can unsubscribe from promotional emails by clicking the “unsubscribe” link or visiting our Email Settings page. You can opt out of mobile push notifications in your device’s settings page. You can opt out of SMS text communications by texting STOP. If you want to stop receiving promotional e-mails from EvolutionRed, click on the “unsubscribe” link at the bottom of any promotional email. Your unsubscribe request or e-mail preferences change will be processed promptly, and in no event longer than ten business days. During that processing period, you may receive additional promotional emails from us. If you want to stop receiving push notifications, which are messages an app sends you on your mobile device even when the app is not on, you can turn off push notifications by visiting your mobile device’s “settings” page. Many of our games also offer the ability to turn off push notifications in the in-game “settings” page. You can opt out of receiving SMS text messages by texting back STOP to the number we send the text from for that particular SMS text messaging program or by emailing us. When we receive an opt-out message from you for SMS text messages, we may send a text message confirming receipt. Please note that if you opt out of receiving promotional communications from us, we may still communicate with you from time to time if we need to provide you with information about the Services you are using from us, if we need to request information from you with respect to a transaction initiated by you, or for other legitimate non-marketing reasons, for example, if we are required under applicable laws to notify you of updates to this Privacy Policy or our Terms of Service.
